Terms of Service

By creating an account, messaging the Tryps agent, adding the Tryps agent to a group conversation, or otherwise using the Service, you agree to these Terms. If you do not agree, do not use the Service.
Who Can Use Tryps
You must be at least 18 years old (or the age of legal majority where you live) to use the Service. By using the Service, you represent that you meet this requirement and that you have the legal capacity to enter into these Terms. If you are using the Service on behalf of a company or other entity, you represent that you have the authority to bind that entity, and "you" refers to that entity.
You may not use the Service if we have previously terminated your account or if you are barred from receiving the Service under applicable law.
Your Account
To use most features, you will need to create an account by providing a valid mobile phone number and verifying it by SMS. You are responsible for:
- Maintaining the confidentiality of your account credentials and your mobile device
- All activity that occurs on your account, including messages sent to or from the Tryps agent using your phone number
- Providing accurate information and keeping it up to date
- Notifying us promptly at support@trypsagent.com if you believe your account has been compromised
We may suspend or terminate your account at any time in accordance with Section 12.
The Service
Tryps is an AI-powered travel agent that helps you and the people you travel with plan, coordinate, and book trips. The Service includes:
- An iMessage and SMS agent you can chat with directly or add to group conversations
- A mobile application for managing trips, itineraries, expenses, people, and bookings
- Voice calls initiated through the agent
- Integrations with third-party providers including Duffel (flights), Stripe (payments), Apple iMessage, and others identified in our Privacy Policy
Tryps uses large language models and other AI systems to understand your messages and generate responses. AI output can be inaccurate, incomplete, or out of date. You are responsible for reviewing travel information (including prices, itineraries, and booking details) before relying on it or making a purchase.
Tryps in Conversations
A core feature of Tryps is the ability to add our agent to a group chat (iMessage or SMS) with your travel companions. Because that involves people who may not have individually agreed to these Terms, this section sets out what the agent will and will not do, and what responsibilities you take on when you bring others into a conversation with Tryps.
4.1 Your Authority and Responsibility
When you add the Tryps agent to a group conversation, or introduce the Tryps agent to another person, you represent and warrant that:
- You have a good-faith basis to believe the other participants are willing to communicate with an AI travel agent in that conversation
- You have the legal right and authority to share their phone numbers, names, and any other information about them with Tryps for the purpose of coordinating travel
- You will, to the extent required by applicable law, inform the other participants that Tryps is an AI agent operated by Tryps Inc. and that messages in the conversation will be processed by Tryps as described in our Privacy Policy
- You are not adding Tryps to a conversation for the purpose of harassment, spam, surveillance, or any unlawful purpose
You are solely responsible for your decision to add Tryps to a group conversation and for any consequences of that decision with respect to the other participants.
4.2 In-Group Messaging
When the Tryps agent is in a group conversation, the agent may:
- Send a one-time identifying notice the first time a phone number appears in a Tryps-hosted conversation — identifying Tryps as an AI agent, linking to these Terms and our Privacy Policy, and explaining how to opt out. We send this notice once per phone number across that person's lifetime with Tryps, not once per conversation
- Respond to messages sent in the conversation about travel planning, bookings, coordination, and related tasks
- Proactively contribute where useful (for example, summarizing options, flagging decisions, confirming bookings)
- Invite other participants to create their own Tryps account by posting an onboarding link in the group conversation
4.3 One-to-One Messaging with Non-User Participants
Tryps will not send unsolicited one-to-one messages to a participant who has not separately signed up for Tryps. One-to-one messaging will begin only if:
- The participant creates a Tryps account by tapping the onboarding link and agreeing to these Terms
- The participant initiates one-to-one contact by sending a message directly to the Tryps number outside of the group conversation
- Applicable law and our internal policy otherwise permit a particular one-to-one message
4.4 Opt-Out
Any participant in a conversation with Tryps can opt out at any time by:
- Replying STOP to the Tryps number — we will stop sending messages from the Tryps agent to that phone number across all Tryps-hosted conversations
- Removing the Tryps agent from the group conversation
- Emailing privacy@trypsagent.com to request that we stop processing their messages and delete their personal information
Replying START reverses a prior STOP. Replying HELP returns contact information for support.
4.5 Use by Participants
If you are a participant in a group conversation to which someone else added the Tryps agent, and you continue to send messages after receiving our notice, you agree that your messages are subject to these Terms for the purpose of that conversation and that Tryps may process those messages as described in our Privacy Policy. You are not required to create a Tryps account to participate, and you may opt out as described in Section 4.4.
Bookings, Payments, and Third-Party Providers
5.1 Third-Party Providers
Tryps helps you book travel-related products and services (such as flights, hotels, and rides) provided by third parties ("Providers"). When you make a booking through Tryps, you are entering into a separate contract with the Provider, and the Provider's own terms, cancellation policies, refund rules, and fees apply. Tryps is not the Provider, is not a party to that contract, and does not warrant the Providers' services.
5.2 Payments
Payments through the Service are processed by Stripe, Inc. and, where applicable, the relevant Provider or booking platform (for example, Duffel for flights). By making a booking, you authorize Tryps and the applicable payment processor to charge your selected payment method for the amount of the booking plus any applicable taxes, fees, or service charges disclosed to you at the time of booking.
5.3 Prices and Availability
Travel prices and availability change frequently. A price quoted by the Tryps agent may not be the price at the time you actually book, and inventory may be gone by the time you confirm. We make reasonable efforts to show accurate information, but we do not guarantee that prices, availability, itineraries, or other travel details are accurate or current.
5.4 Refunds and Cancellations
Refunds, changes, and cancellations are governed by the Provider's policies. Tryps can help you submit requests, but we cannot override a Provider's rules. Where we charge a service fee for Tryps itself, we will disclose it at the time of the transaction.
Your Content
"User Content" means any content you submit to the Service, including messages to the agent, photos, itinerary information, contact details, and any other information.
6.1 Your Ownership
You retain ownership of the User Content you submit. You are responsible for your User Content and for making sure you have the rights necessary to submit it.
6.2 License to Tryps
You grant Tryps a worldwide, non-exclusive, royalty-free license to host, store, process, transmit, display, reproduce, and create derivative works of your User Content solely to (a) operate and provide the Service to you and the people you communicate with through the Service, (b) improve and develop the Service (including training and evaluating AI models, subject to the protections described in our Privacy Policy), and (c) comply with applicable law.
You may revoke this license for future processing by deleting the applicable content or closing your account, except to the extent we are required to retain it by law, it has been aggregated or de-identified, or it has been incorporated into backups or model training data in a way that makes removal technically impracticable.
6.3 Feedback
If you send us feedback or suggestions about the Service, you grant us a perpetual, irrevocable, royalty-free license to use that feedback without restriction.
Acceptable Use
You agree not to use the Service to:
- Violate any law or regulation, or infringe any third party's rights (including privacy, publicity, or intellectual property rights)
- Send spam, bulk messages, or unsolicited commercial messages, or add the Tryps agent to conversations you reasonably believe the other participants do not want
- Harass, threaten, or defame any person, including by causing the Tryps agent to send messages on your behalf that you know are unwelcome
- Submit false, misleading, or fraudulent information, including fake bookings or stolen payment credentials
- Reverse engineer, scrape, or attempt to extract training data, model weights, system prompts, or non-public information from the Service
- Use the Service to build or train a competing AI product
- Interfere with or disrupt the Service, including by circumventing rate limits or security controls
- Use automated tools to interact with the Service except as we expressly permit
- Use the Service in a way that violates the terms of any underlying messaging platform (including Apple's iMessage terms and applicable carrier terms)
We may investigate and take action, including suspending or terminating your account, if we reasonably believe you have violated this section.
Intellectual Property
The Service, including all software, designs, text, graphics, and the Tryps name and logo, is owned by Tryps or its licensors and is protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for its intended purpose, subject to these Terms. We reserve all rights not expressly granted.
"Tryps" and the Tryps logo are trademarks of Tryps Inc. You may not use them without our prior written permission.
Privacy
Our Privacy Policy, available at trypsagent.com/privacy, describes how we collect, use, and share information. By using the Service, you acknowledge the practices described in our Privacy Policy.
Third-Party Services
The Service integrates with third-party services, including Apple iMessage and SMS carriers, Duffel, Stripe, Supabase, and the large language model providers we use to power the agent. Your use of those services may be subject to their own terms and privacy policies. We are not responsible for the acts or omissions of third-party services, and we do not endorse them.
Disclaimers
Travel information generated by an AI agent is not a substitute for verifying details with the Provider before you travel. You are responsible for confirming all bookings, prices, dates, and travel requirements (including passport, visa, and health requirements).
Some jurisdictions do not allow the exclusion of certain warranties. To the extent any such warranty cannot be disclaimed, it is limited to the maximum extent permitted by applicable law.
Suspension and Termination
You may stop using the Service at any time and may delete your account through the app or by emailing support@trypsagent.com.
We may suspend or terminate your access to the Service at any time, with or without notice, if we reasonably believe you have violated these Terms, if we are required to do so by law, or if continuing to provide the Service to you would expose Tryps or others to material risk.
On termination, Sections 2 (final sentence), 5.1, 5.4, 6.2 (for prior content to the extent retained), 6.3, 7, 8, 11, 13, 14, 15, and 16 survive.
Limitation of Liability
Tryps's total liability for all claims arising out of or relating to the Service or these Terms is limited to the greater of (a) the amounts you paid to Tryps for the Service in the twelve months preceding the event giving rise to the claim, or (b) $100 USD.
These limitations do not apply to liability that cannot be limited under applicable law (for example, gross negligence, willful misconduct, or fraud, where applicable). The limitations apply whether a claim is based in contract, tort, statute, or any other theory.
Indemnification
To the extent permitted by law, you will indemnify, defend, and hold harmless Tryps and its directors, officers, employees, and agents from and against any third-party claim, demand, proceeding, loss, damage, liability, cost, or expense (including reasonable attorneys' fees) arising out of or relating to:
- Your use of the Service
- Your User Content
- Your breach of these Terms
- Your decision to add the Tryps agent to a conversation, including any claim by another participant that you lacked authority to share their information with Tryps or to include them in the conversation
- Your violation of any applicable law or of any third party's rights
We will promptly notify you of any claim subject to this section, and you agree to cooperate with our defense. We may, at our option, assume control of the defense and settlement of any claim, at your expense.
Dispute Resolution; Arbitration; Class-Action Waiver
15.1 Informal Resolution
Before filing any formal claim, you agree to first email us at legal@trypsagent.com with a description of the dispute and attempt to resolve it informally. We will try to resolve the dispute within 60 days of receipt.
15.2 Binding Arbitration
If we cannot resolve a dispute informally, you and Tryps agree that any dispute arising out of or relating to the Service or these Terms will be resolved by binding individual arbitration administered by JAMS under its Streamlined Arbitration Rules and Procedures. The arbitration will be seated in Austin, Texas, and conducted in English. Judgment on the award may be entered in any court of competent jurisdiction.
15.3 Class-Action Waiver
15.4 Exceptions
Either party may bring an individual action in small-claims court. Either party may seek injunctive or equitable relief in court to protect intellectual property rights or to address unauthorized access to the Service.
15.5 Opt-Out
You may opt out of Sections 15.2 and 15.3 by emailing legal@trypsagent.com within 30 days of first accepting these Terms, with the subject line "Arbitration Opt-Out" and your name and phone number.
15.6 Governing Law and Venue
These Terms are governed by the laws of the State of Delaware, without regard to conflict-of-laws rules. If arbitration does not apply to a dispute, the dispute will be brought exclusively in the state or federal courts located in Travis County, Texas, and you consent to the jurisdiction of those courts.
Miscellaneous
Changes. We may update these Terms from time to time. If we make material changes, we will notify you through the Service, by SMS to your verified phone number, or by another reasonable method. Your continued use of the Service after the effective date of the updated Terms constitutes acceptance.
Entire Agreement. These Terms, together with the Privacy Policy and any additional terms for specific features, are the entire agreement between you and Tryps regarding the Service.
No Waiver. Our failure to enforce a provision is not a waiver of our right to do so later.
Severability. If any provision is held unenforceable, the remaining provisions remain in effect.
Assignment. You may not assign these Terms without our prior written consent. We may assign these Terms in connection with a merger, acquisition, or sale of assets.
